Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and E&S Construction And Remodeling LLC ('Company', 'we', 'us', or 'our') concerning your use of our construction and remodeling services.

By engaging our services or signing a contract with us, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

1. Services Provided

E&S Construction And Remodeling LLC provides professional construction and remodeling services including but not limited to:

• Kitchen remodeling and renovations

• Bathroom renovations and upgrades

• Deck and patio construction

• Exterior work and siding

• Flooring installation

• Staircase renovation

• General remodeling and construction

All services are provided in accordance with Connecticut state regulations and building codes. We hold HIC License #0703273 and maintain $4,000,000 in general liability insurance through Benchmark Insurance Company.

2. Warranties and Guarantees

We provide a one (1) year warranty on all remodeling work performed by E&S Construction And Remodeling LLC. This warranty covers:

• Defects in workmanship

• Issues arising from improper installation

• Repairs needed due to our work

This warranty does NOT cover:

• Damage caused by the client or third parties

• Normal wear and tear

• Damage from improper maintenance

• Materials defects (covered by manufacturer warranty)

• Issues arising from client modifications to completed work

For warranty service, contact us immediately. If repairs are needed due to client-caused damage, we will provide service at our standard rates.

3. Payment Terms and Methods

Payment terms are discussed and agreed upon with each client in person before work begins. This personalized approach allows us to understand your financial capacity and provide flexible payment options.

Typical payment structure:

• Initial deposit: Amount determined during consultation

• Progress payments: Agreed upon based on project milestones

• Final payment: Upon project completion and your satisfaction

Accepted payment methods:

• Online transfers (Venmo, CashApp, bank transfer)

• Checks

• Cash (for small projects only)

All payment terms will be clearly outlined in your signed contract.

4. Cancellation and Refund Policy

If you need to cancel a project:

• Notify us immediately in writing or via WhatsApp

• We will calculate charges based on:

- Materials purchased (non-returnable items are charged in full)

- Materials used (charged in full)

- Labor completed (charged at daily rates for days worked)

- Returnable unused materials (refund after successful return to supplier)

Refunds:

• Any deposit amount minus the charges listed above will be refunded

• Refunds are processed within 14 business days

• Original payment method will be used for refunds when possible

We reserve the right to cancel services if:

• Client fails to make agreed-upon payments

• Site conditions are unsafe or unsuitable

• Client behavior is threatening or abusive to our team

5. Liability and Insurance

E&S Construction And Remodeling LLC maintains comprehensive general liability insurance with $4,000,000 coverage through Benchmark Insurance Company (Policy #CBG-00334274-00).

Our liability is limited to:

• Direct damages caused by our negligence or breach of contract

• Amounts covered under our insurance policy

• Actual damages (not speculative or consequential damages)

We are NOT liable for:

• Delays due to weather, material shortages, or supplier issues

• Hidden conditions discovered during construction

• Client-requested changes that impact project timeline or cost

• Damage to property not related to our work scope

• Third-party actions or natural disasters

6. Dispute Resolution and Governing Law

In the event of any dispute arising from our services:

• Contact us directly to resolve the matter informally

• We are committed to fair and reasonable resolution

• If informal resolution fails, disputes will be resolved through mediation

• Arbitration or litigation will be governed by Connecticut state law

• Venue for any legal proceedings shall be in New London County, Connecticut

These Terms of Service are governed by and construed in accordance with the laws of the State of Connecticut.
